Many are erroneously claiming that the phrase subject to the jurisdiction thereof only applies to the children of diplomats and that clearly wasn't Congress's intent as when the 14th was passed, they excluded Native Americans due to Congress deeming them subject to tribal jurisdiction. So, Congress meant full and complete jurisdiction to the United States a standard to which illegal aliens and temporary visa holders are incapable of meeting.

Not saying the court will uphold Trump's executive order but their legal case is a lot stronger than many would have people believe. If SCOTUS were to rule that phrase means complete and full jurisdiction of the US, then they ultimately would have to rule that children of illegal aliens and temporary visa holder don't meet the plain text of the 14th Amendment and are ineligible to be conferred US citizenship.
